Ryan L. Marshall
Mr. Marshall has extensive prosecution experience with patent and trademark matters as well as litigation experience with patent, trade secret, trade dress and unfair trade practice claims. He has substantial experience in the chemical, pharmaceutical and biochemical arts. Mr. Marshall has a master's degree in chemistry and eight years of laboratory research experience. As a graduate student, he investigated nucleoside and peptide chemistry including the synthesis of novel compounds and characterization of protein interactions with lipopolysaccharides using spectroscopy and calorimetry. He counsels clients and prepares opinions relating to patentability, invalidity, enforceability, infringement and clearance issues. He has worked with a broad range of chemical technologies, particularly in the fields of polymers, chemical instruments, fuel processing, animal health and pharmaceuticals including synthesis, peptides, protein complexes and chelates, nucleosides, DNA sequence tags, point-of-care DNA diagnostics and DNA amplification. He has also worked with design and utility patents for and assessments of propellants, explosives, veterinary products and feed supplements, synthetic diamond drill bits, body armor, outdoor gear, eyewear, batteries and fuel cells, water softeners, packaging and medical devices including stents and stent delivery devices. Mr. Marshall advises clients on strategic patent portfolio development, landscape analysis, ANDA and ANADA opinions and in drafting U.S. and foreign patent applications. He also performs intellectual property evaluations, audits, due diligence, and clearance searches and reviews.

- Seirus Innovative Accessories v. Do-Gree Fashions Ltd., No. 2:05-cv-355 (D. Utah 2007-2008). Represented Do-Gree in multiple-patent case and trade dress relating to skiwear, which settled shortly after the client received a favorable claim interpretation ruling, but before the pending motions for summary judgment of non-infringement were decided.
- Amway Corp. v. MonaVie, Inc., et al. (D. Utah 2008-2010). Represented the defendant/consolidated plaintiff in an action for claims involving a misappropriation of trade secret, a tortious interference with contract, false advertising and related class action for enforceability of contract. The parties settled during pretrial proceedings.
